Terms of Service

These terms govern use of Anecdotario (the service). By creating an account or using the app you agree to abide by them. If you don't agree, don't use the service.

1. Who we are

Anecdotario is operated by Orionis SAS, domiciled in Montevideo, Uruguay. General contact: hola@orionis.consulting.

2. Eligibility

You must be 18 or older. By creating an account you represent that you meet this requirement.

3. Your account

You are responsible for:

  • Keeping your password secure.
  • All activity in your account.
  • Notifying us if you suspect unauthorized access.

If you authenticate with Google, Google's terms also apply.

4. What the service does

Anecdotario lets you:

  • Save anecdotes in text, audio, or photo.
  • Receive guided questions to build your autobiography.
  • Share anecdotes with friends inside the app.
  • Generate derivative compositions (short stories, screenplays, novels) from your anecdotes.
  • View stats and trophies for your activity.

The service evolves over time. We may add, modify, or discontinue features with reasonable notice when material.

5. Your content is yours

Anecdotes, audios, photos, and compositions you create are your property. You retain all copyright.

To operate the service you grant us a limited, non-exclusive, worldwide, royalty-free license to host, transmit, process (including sending fragments to Anthropic and OpenAI to generate questions and transcribe audio), back up, and display your own content to you. This license ends when you delete your account.

We will never use your content to train general AI models, display it publicly without your consent, or sell it to third parties.

6. People mentioned in your anecdotes

When you mention other people, you represent that:

  • You have the right to tell their story from your perspective.
  • You are not defaming or unlawfully invading their privacy.
  • If they ask to be removed, you will do so (or notify us so we can).

Notice-and-takedown procedure: we don't review your content proactively. If a mentioned person asks for removal, they must email privacy@orionis.consulting with (i) identification of the content, (ii) reasonable proof of identity, and (iii) the legal basis for the request (defamation, image rights, privacy, etc.). We respond within 7 business days. We notify you before taking action and let you respond. If the request has clear legal basis and you don't respond within a reasonable period, we may anonymize the mention or remove the anecdote.

7. AI and compositions

Suggested questions, draft structuring, and generated compositions come from AI models. They may contain errors, inaccuracies, biases, or fictionalizations of real people mentioned in your anecdotes. You decide what to keep, edit, or discard.

Compositions are yours, but generating them uses service credits that have a computational cost for us. We limit generation according to your plan.

Before sharing or publishing a composition outside Anecdotario, you are responsible for reviewing it regarding image rights, honor, and privacy of any persons mentioned. The existence of a composition does not constitute authorization from those persons.

8. Acceptable use

You may not:

  • Upload illegal, abusive, defamatory content or content infringing third-party rights.
  • Upload material you don't own or have rights to.
  • Attempt to access other users' accounts or data.
  • Reverse engineer, mass scrape, or use the service in unauthorized automated ways.
  • Resell or sublicense the service.
  • Use the app for harassment, threats, or sharing third-party personal information without consent.

If we detect misuse we may suspend or terminate your account without refund.

9. Subscriptions and payments

IMPORTANT, Auto-renewal. Your subscription renews automatically at the price in effect at renewal. We send a reminder email at least 7 days before each annual renewal. You can cancel at any time from the payment provider portal (Lemon Squeezy or Mercado Pago); cancellation takes effect at the end of the paid period.

Some features require a subscription (Pro, Legado) or credit packs. Prices appear at /pricing and are charged via Lemon Squeezy or Mercado Pago depending on your country.

  • Monthly renews monthly until cancelled.
  • Annual renews yearly.
  • Legado includes the printing and shipping of one physical book per year, to Uruguay and countries where we have logistical availability (check at purchase time). Estimated delivery: 4–8 weeks from order. If we cannot deliver within the year for reasons not attributable to you, we reprint in the next period or refund USD 80 of the plan cost.

You can cancel anytime from the payment provider portal. Cancellation takes effect at the end of the paid period.

10. Refunds and right of withdrawal

You have withdrawal rights we honor regardless of these terms:

  • Uruguay: 5 business days from purchase (Law 17.250 art. 16).
  • European Union: 14 days from purchase (Directive 2011/83/EU).
  • Brazil: 7 days from purchase (CDC art. 49).

To withdraw, email hola@orionis.consulting. We refund within 7 days via the same payment method, deducting any consumption made during the period (credits used, compositions generated).

To access digital content immediately (compositions, premium credits) during the withdrawal period, you may explicitly waive the right at checkout, this is optional and you may always wait out the period.

After the withdrawal period, we don't offer general refunds unless the service was unusable due to a fault on our side, in which case we refund pro-rata for the affected period.

11. Suspension and termination

You can delete your account anytime from your profile. Data is erased within 30 days, with an option to export everything as JSON + media files before deletion.

We may suspend or terminate your account if:

  • You breach these terms. Proven breach means no refund.
  • There is reasonable suspicion of fraud or abuse.
  • Ordered by an authority.
  • We discontinue the service. We give 30-day notice, an export option, and pro-rata refund of unused subscription period.

After termination, unused credits are kept for 30 days in case of reactivation; after that they are forfeited, except when termination is due to service discontinuation (in which case they are refunded).

12. Warranties and liability

The service is provided "as is" and "as available". We do not warrant it will be free of errors, interruptions, or data loss, although we take reasonable measures to prevent them (daily backups, RLS, monitoring).

To the maximum extent permitted by law, and without prejudice to non-waivable consumer rights granted by your country's law:

  • We are not liable for indirect, incidental, special, or consequential damages.
  • Our aggregate liability is limited to the amount you paid for the service in the 12 months preceding the claim, or USD 100, whichever is greater.

This limitation does NOT apply to:

  • Damages caused by our gross negligence or wilful misconduct.
  • Personal injury (physical or serious emotional) when legally proven.
  • Non-waivable consumer rights under Law 17.250 (Uruguay), CDC (Brazil), or equivalent EU rules.
  • Violations of your data-protection rights that trigger statutory compensation.

13. Indemnification

You agree to indemnify and hold us harmless against third-party claims arising from your content (including people mentioned), your breach of these terms or applicable law, or your misuse of the service.

This indemnification has the same limits as §12 and does NOT apply to claims arising from our gross negligence, wilful misconduct, or violation of your data-protection rights. We will notify you without delay of any third-party claim that may involve you and let you participate in the defense.

14. Changes to terms

If we change the terms:

  • Materially adverse changes (price, service scope, rights): we ask for your explicit acceptance before they take effect. If you don't accept within 30 days, you may terminate your account and request a pro-rata refund of any unused period.
  • Non-material changes (corrections, clarifications, wording improvements): take effect on notice; continued use implies acceptance.

In all cases we maintain a public version history of these terms.

15. Governing law

These terms are governed by the laws of the Eastern Republic of Uruguay. Disputes are resolved in the ordinary courts of Montevideo, with the following carve-outs for consumers:

  • Consumers domiciled in Uruguay may sue at their domicile (Law 17.250 art. 30).
  • Consumers residing in the EU may sue in their state of residence (Brussels I bis Regulation art. 18).
  • Consumers in Brazil retain the forum of their domicile (CDC art. 101).

16. Miscellaneous

  • Force majeure: we are not liable for breach due to force majeure (prolonged cloud-provider outage, mass cyber attack, government decisions, natural disaster, armed conflict, pandemic). We give notice and make reasonable efforts to restore service. If unavailability exceeds 30 continuous days, you may terminate the subscription and request a pro-rata refund.
  • Severability: if any clause is invalid, the rest remain in force.
  • No waiver: failing to enforce a right once doesn't waive it.
  • Assignment: you may not assign your account. We may assign these terms to a business successor with notice.
  • Entire agreement: these terms together with the Privacy Policy form the entire agreement between you and us regarding the service.
